The short version: Nightwise shows what your CPAP machine recorded, entirely on your phone. It is an information tool, not a medical device. Importing a card and your newest 7 nights in full detail are free. Nightwise Pro is optional: an annual subscription with a 7-day free trial, a monthly subscription, or a one-time Lifetime unlock, each billed by Apple or Google and cancelable anytime in your app store account settings. Connecting your ChatGPT plan is optional too, and free. The app is provided "as is".
The app is operated by OnIT Tech Pty Ltd (ABN 71 670 099 395), trading as Mental Metal ("we", "us"). By downloading or using the app you agree to these Terms of Use. If you do not agree, please do not use the app. Questions: [email protected].
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for your own personal use. You agree not to copy, sell, sublicense, reverse engineer, or attempt to extract the source code of the app except to the extent permitted by law.
Importing a card, every night's own numbers, the newest 7 nights in full detail, and the 7-night trends are free. Nightwise Pro unlocks every night in full detail, the breath-by-breath view, longer trends, the setting-change compare, and the doctor report PDF. It is offered three ways:
Purchases are sold and billed through the Apple App Store or Google Play, under their terms. Payment is charged to your app store account at confirmation of purchase. A subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours of the period end. The Lifetime option is a single charge and does not renew. Prices are shown in the app before purchase and may vary by region and over time. You manage or cancel a subscription in your Apple Account or Google Play account settings, not in the app, and any unused portion of a free trial is forfeited when you buy a subscription. Refunds are handled by Apple or Google under their policies.
The optional ChatGPT plan features (section 4) are free in Nightwise, are never billed by us, and are not part of Nightwise Pro.
Nightwise reads the SD card you choose, copies its files into the app's own storage on your phone, and shows you what your machine recorded. Your data is not uploaded to us and is never stored on any server. The SD card is never changed. You are responsible for your device and for keeping your own backups of any data that matters to you; deleting the app, or using Delete all data, removes the related local data. How we handle the limited anonymous diagnostic and purchase data is described in our Privacy Policy.
You may choose to connect your own ChatGPT plan so that Nightwise can write plain-language explanations of your nights. If you do, you agree to OpenAI's terms for using your ChatGPT plan in other apps, and the requests Nightwise makes on your behalf are between you and OpenAI; we are not a party to them, we do not charge for them, and we hold no copy of what is sent or answered. You can disconnect at any time in More > ChatGPT plan.
Nightwise is an information tool that shows what your machine recorded. It is not a medical device, does not diagnose, and never replaces advice from your doctor or sleep clinician. Explanations written with your ChatGPT plan are general information, not medical advice. Do not change your machine's pressure or any other setting based on the app; talk to a qualified health professional first, and never disregard professional medical advice because of something in the app.
You agree to use the app lawfully, only with data you have the right to use, and not to interfere with its operation or security. The app processes your card's files on your device; results depend on your device, your machine, and the files on the card.
The app is provided on an "as is" and "as available" basis without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted or error-free, that it will read every card or machine correctly, or that any explanation written with your ChatGPT plan is accurate or complete. Nothing in these terms excludes rights you have under consumer law (including the Australian Consumer Law) that cannot lawfully be excluded. Subject to that, to the maximum extent permitted by law our liability arising from your use of the app is limited, and we are not liable for indirect or consequential loss, including any loss of data where you have not kept your own backups.
We may update the app and these terms from time to time. Material changes will be reflected here with a revised "Last updated" date. Continued use after a change means you accept the updated terms.
These terms are governed by the laws of Australia, without limiting any mandatory consumer protections that apply where you live.
